Privacy Policy

Welcome to www.babethsfeast.com (the “Site”), a website operated by Babeth’s Feast, Inc. (“Babeth’s Feast”, “we”, “us”, or “our”). We know you are concerned about your privacy, so we developed this privacy policy (“Privacy Policy”) to explain how we collect, use, and disclose information from and/or about you, whether you are simply visiting our Site or using any of our related services, including but not limited to purchasing products on our Site or participating in promotions offered by us (“Services”).

So we are clear about the terminology we are using, when we use the phrase “Personal Information” in this Privacy Policy, we mean contact information (e.g., name, address, email address, or telephone number) and any other non-public information that is used or intended to be used to personally identify an individual. When we use the phrase “Anonymous Information” in this Privacy Policy, we mean information that is neither used nor intended to be used to personally identify an individual.

If we make any changes to our privacy policy, we will inform you by posting a notice on our Site. Those changes will go into effect on the date posted in the notice. The new policy will apply to all current and past users of our Site and will replace any prior policies that are inconsistent.

Children.

The Site is not directed to children and children are not eligible to use our Site. Protecting the privacy of children is very important to us. We do not collect or maintain Personal Information from people we actually know are under 13 years of age, and no part of our Site is designed to attract people under 13 years of age. In fact, if you are under 18, please do not use this Site or any of the Services. When the Site does collect age information, and users identify themselves as under 13, we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilizing the Site.

How We Collect Information.

Personal Information

In general, the Personal Information we gather enables us to provide the Site and Services to you. We collect Personal Information that you submit to us voluntarily when you register with us or when your use the Site or Services. To create an “Account”, we require that you provide us with certain Personal Information, including your first and last name, and an e-mail address. We also require that you provide us with a password that you will use to sign into your Account.

There will be times, such as when placing an order, subscribing to a service, or participating in promotions, when we may request additional Personal Information, such as your billing/shipping address, telephone number, credit card information, or other information. It is solely your choice whether or not you provide this information. However, should you choose not to provide the information, we may be unable to process your order, fulfill a service or display certain content on our Site.

Our online store is hosted by BigCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your Personal Information is stored through BigCommerce’s data storage, databases and the general BigCommerce application. BigCommerce stores your Personal Information and other data on a secure server behind a firewall. If you choose a direct payment gateway to complete your online purchase through our Site (versus making a payment via Paypal), then your payment information is subjet to our payment gateway, Braintree by PayPal’s privacy policy regarding payments.

When you send an email or other communication to us, we may retain those communications in order to process your inquiries, respond to your requests and improve our Services. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply.

To the extent you post Personal Information in comments in a publicly available area of our Services (e.g., ratings and reviews), it will be available to other users of the Services who may use it at their discretion. Please be thoughtful about the information that you post in any public areas of the Site.

Anonymous Information

Information Collected by Our Servers. Our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, clickstream data, and a date/time stamp for your visit.

Cookies. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs. Personal Information

We will share your Personal Information with third parties for the purpose of providing the Services. When you authorize us to disclose information to third parties, the use and disclosure restrictions contained in this Privacy Policy will not apply to them.

In the event of an insolvency, bankruptcy, or receivership, Personal Information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

We reserve the right to disclose Anonymous Information publicly without restriction, including to third party vendors who may help us enhance or provide the Site or to third parties.

Information Disclosed to Third Parties

This Privacy Policy addresses our use and disclosure of information we collect from and/or about you on the Site. If you disclose information to others, including payment processors, different rules may apply to their use or disclosure of the information you disclose to them. The use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

The Site may contain links to other websites that are not owned or controlled by us, including our partner sites. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site. During this process, another entity may collect Personal Information or Anonymous Information from you. The Site may also contain links to other websites controlled by us but which operates under different privacy policies. Please review the privacy policy of any new website you visit.

Updating and Controlling Your Information.

If you have an Account with us, you may update certain of your Personal Information on our Site. You may also email us at contact@babeths.com. You may request deletion of your Personal Information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives and we may also retain Personal Information about your use of our Site and activities on the Site. Once we disclose some of your Personal Information to third parties, we cannot access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

Changes to this Privacy Policy.

This Privacy Policy is subject to revision from time to time on a going-forward basis. We will post any revised version of the Privacy Policy on this page. If we make any material changes to it, we will also send you notice to the last email address you have provided to us. Continued use of our Site or Services following notice of such changes will indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
